Criminal Code of the Republic of China Article 84

Execution is barred by the statute of limitations if it is not carried out within the following statutory periods:1. Forty years for an offense for which the pronounced sentence is death, life imprisonment, or imprisonment for not more than ten years;2. Thirty years for an offense for which the pronounced sentence is imprisonment for not less than three years but not more than ten years;3. Fifteen years for an offense for which the pronounced sentence is imprisonment for not less than one year but not more than three years;4. Seven years for an offense for which the pronounced sentence is imprisonment for less than one year, short-term imprisonment, or a fine.The statutory periods provided for in the preceding paragraph shall commence from the day judgment becomes final but if rehabilitative measures precede the execution of criminal punishment, the statutory period shall commence from the completion date of implementing rehabilitative measures.

行刑權因下列期間內未執行而消滅：
一、宣告死刑、無期徒刑或十年以上有期徒刑者，四十年。
二、宣告三年以上十年未滿有期徒刑者，三十年。
三、宣告一年以上三年未滿有期徒刑者，十五年。
四、宣告一年未滿有期徒刑、拘役或罰金者，七年。
前項期間，自裁判確定之日起算。
但因保安處分先於刑罰執行者，自保安處分執行完畢之日起算。
