A person who commits an offense specified in paragraph 1 of the preceding article and intentionally kills his victim shall be sentenced to death or life imprisonment.A person who commits an offense specified in paragraph 1 of the preceding article and who has one of the following circumstances shall be sentenced to death or life imprisonment or imprisonment for not less than twelve years:1. Forcing the victim to commit sexual intercourse2. Resulting in aggravated injury
中文原文 中華民國刑法第348條
犯前條第一項之罪而故意殺人者，處死刑或無期徒刑。
犯前條第一項之罪而有下列行為之一者，處死刑、無期徒刑或十二年以上有期徒刑：
一、強制性交者。
二、使人受重傷者。
犯前條第一項之罪而有下列行為之一者，處死刑、無期徒刑或十二年以上有期徒刑：
一、強制性交者。
二、使人受重傷者。
