A person who takes advantage of the mental or physical handicap, mental or intellectual defect, or a similar condition which makes resistance impossible for intercourse with a male or a female shall be sentenced to imprisonment for not less than three years but not more than ten years.A person who takes advantage of the mental or physical handicap, mental or intellectual defect, or a similar condition which makes resistance impossible for obscene behavior with a male or a female shall be sentenced to imprisonment for not less than six months but not more than five years.An attempt to commit an offense prescribed in paragraph is punishable.

對於男女利用其精神、身體障礙、心智缺陷或其他相類之情形，不能或不知抗拒而為性交者，處三年以上十年以下有期徒刑。
對於男女利用其精神、身體障礙、心智缺陷或其他相類之情形，不能或不知抗拒而為猥褻之行為者，處六月以上五年以下有期徒刑。
