Trust Law Article 59
Upon the resignation or removal of a trust supervisor, the person who designates or appoints him may appoint a new trust supervisor. The court may also, upon application of the interested party or the prosecutor, appoint a new trust supervisor if a trust supervision cannot be appointed or if no trust supervisor is appointed.The preceding paragraph shall apply mutatis mutandis if the trust supervisor refuses or fails to accept the appointment.

信託監察人辭任或解任時，除信託行為另有訂定外，指定或選任之人得選任新信託監察人；不能或不為選任者，法院亦得因利害關係人或檢察官之聲請選任之。
信託監察人拒絕或不能接任時，準用前項規定。
