Administrative Procedure Act Article 158
A legal order shall be of no force and effect in any of the following circumstance:1. Being in conflict with the Constitution or inconsistent with any law or an order of the superior authority;2. Depriving the people of their freedom or rights or imposing any restriction thereon without authorization by law; or3. Being non-approved by another authority if such approval is required by law.A legal order that is partly void does not affect the validity of the remaining part, except where the regulatory purposes of the legal order would become unattainable without the part that is void, in which case the legal order shall be void in its entirety.

法規命令，有下列情形之一者，無效︰一、牴觸憲法、法律或上級機關之命令者。
二、無法律之授權而剝奪或限制人民之自由、權利者。
三、其訂定依法應經其他機關核准，而未經核准者。
法規命令之一部分無效者，其他部分仍為有效。
但除去該無效部分，法規命令顯失規範目的者，全部無效。
