Administrative Procedure Act Article 140
An administrative contract with stipulations which, if performed, may cause encroachment upon any right of a third party , shall be of no force and effect without the written consent of such third party .An administrative contract made in lieu of an administrative disposition which, as required by law or regulation, may only be rendered with the approval or consent of or the joint efforts with another administrative authority, shall be of no force and effect without the approval and consent of or joint efforts with such administrative authority.
中文原文 行政程序法第140條
行政契約依約定內容履行將侵害第三人之權利者，應經該第三人書面之同意，始生效力。
行政處分之作成，依法規之規定應經其他行政機關之核准、同意或會同辦理者，代替該行政處分而締結之行政契約，亦應經該行政機關之核准、同意或會同辦理，始生效力。
