A person who had been declared dead is presumed to be dead at the date fixed in the judgment.In the absence of proof to the contrary, the time of death specified in the preceding paragraph shall be the date of expiration of the period specified in the preceding article.

受死亡宣告者，以判決內所確定死亡之時，推定其為死亡。
前項死亡之時，應為前條各項所定期間最後日終止之時。
但有反證者，不在此限。
