If the rise or fall in land value after the creation of a superficies makes the original rental arising therefrom obviously unfair, the party may file a claim with the court to increase or reduce the rental.If the superficies has no rental and the burden unexpectedly increased after the creation of the superficies make it obviously unfair to use the land for free, the landowner may file a claim with the court to fix the rental.

地上權設定後，因土地價值之昇降，依原定地租給付顯失公平者，當事人得請求法院增減之。
未定有地租之地上權，如因土地之負擔增加，非當時所得預料，仍無償使用顯失公平者，土地所有人得請求法院酌定其地租。
