Civil Code Article 788

The person entitled to access may construct a road when necessary, provided that he shall compensate for any injury caused thereby to the land accessed.In the preceding case, if extensive injury is caused by such access, the landowner may require the person accessing his property to purchase the land accessed and the odd lot caused thereby for a reasonable price, with such price agreed to by both parties. If the parties cannot agree upon the purchase price, the price shall be determined by a court.

有通行權人於必要時，得開設道路。
但對於通行地因此所受之損害，應支付償金。
前項情形，如致通行地損害過鉅者，通行地所有人得請求有通行權人以相當之價額購買通行地及因此形成之畸零地，其價額由當事人協議定之；不能協議者，得請求法院以判決定之。
