An employment guaranty is a contract whereby the parties agree that one of them shall be bound to make compensation when the employee of the other party shall be liable to compensate the other party for the performance of his duties in the future.The contract of the preceding paragraph shall be made in writing.

稱人事保證者，謂當事人約定，一方於他方之受僱人將來因職務上之行為而應對他方為損害賠償時，由其代負賠償責任之契約。
