Civil Code Article 746

The guarantor shall not assert the right specified in the preceding article in any of the following cases:(1) If the guarantor has waived his rights specified in the preceding article.(2) If the principal debtor has been declared bankrupt.(3) If the property of the principal debtor is not sufficient to satisfy the obligation.

有下列各款情形之一者，保證人不得主張前條之權利：
一、保證人拋棄前條之權利。
二、主債務人受破產宣告。
三、主債務人之財產不足清償其債務。
