In the case of a deposit of fungible things, if it is not agreed that the ownership of such things transfers to the depositary with the consent of depositor, the depositary may keep things of the same kind, quality and quantity which are belonged to depositor mixed with the other things from him and other depositors, every depositor gets the ownership in accordance with the percentage of the things mixed together.The depositary keeps the things by the preceding paragraph, may return things of the same kind, quality and quantity to depositor.

寄託物為代替物，如未約定其所有權移轉於受寄人者，受寄人得經寄託人同意，就其所受寄託之物與其自己或他寄託人同一種類、品質之寄託物混合保管，各寄託人依其所寄託之數量與混合保管數量之比例，共有混合保管物。
受寄人依前項規定為混合保管者，得以同一種類、品質、數量之混合保管物返還於寄託人。
