The broker is bound, if so instructed by one of the parties, not to disclose the name of such party or of such party's firm to the other party in the contract.When the broker does not disclose to one of the parties the name of the other party or of the other party's firm, he is personally liable for the performance of the obligations of such other party resulting from the contract and he has authority to receive prestations on behalf on such party.

當事人之一方，指定居間人不得以其姓名或商號告知相對人者，居間人有不告知之義務。
居間人不以當事人一方之姓名或商號告知相對人時，應就該方當事人由契約所生之義務，自己負履行之責，並得為其受領給付。
