When employee performing the services incurs an injury, he may demand to the employer for the injury, if, owing to circumstance for which he is not responsible.If there is someone else who shall be responsible for the injury prescribed in the preceding paragraph, the employer may make a claim against this person for reimbursement.

受僱人服勞務，因非可歸責於自己之事由，致受損害者，得向僱用人請求賠償。
前項損害之發生，如別有應負責任之人時，僱用人對於該應負責者，有求償權。
