The employer shall not transfer his right of the services to a third party without the consent of the employee, and the employee cannot make a third party perform the services in his place without the consent of the employer.If either party violates the provision of the preceding paragraph, the other party may terminate the contract.

僱用人非經受僱人同意，不得將其勞務請求權讓與第三人，受僱人非經僱用人同意，不得使第三人代服勞務。
當事人之一方違反前項規定時，他方得終止契約。
