Although the price is not fixed concretely by the agreement, if it may be decided from the circumstances, it is deemed to be fixed.If it is agreed that the price shall be fixed according to the market price, it is deemed to be fixed according to such market price at the place and time of performance unless otherwise provided by contract.

價金雖未具體約定，而依情形可得而定者，視為定有價金。
價金約定依市價者，視為標的物清償時清償地之市價。
但契約另有訂定者，不在此限。
