The assumption of a debt does not affect the existence of the accessory rights of the claim, unless the accessory rights shall not be separated from the debtor.The securities given by a third party for the performance of the obligation are extinguished on account of the assumption of the debt, unless such third party has acknowledged the assumption.

從屬於債權之權利，不因債務之承擔而妨礙其存在。
但與債務人有不可分離之關係者，不在此限。
由第三人就債權所為之擔保，除該第三人對於債務之承擔已為承認外，因債務之承擔而消滅。
