Civil Code Article 209

Either the creditor or the debtor who has the right of choice shall exercise it by an expression of intent to the other party.If a third party has the right of choice, he shall exercise it by an expression of intent to both the creditor and the debtor.

債權人或債務人有選擇權者，應向他方當事人以意思表示為之。
由第三人為選擇者，應向債權人及債務人以意思表示為之。
