When the object of the prestation is determined only in kind, if its quality cannot be determined by the nature of the juridical act or the intent of the parties, the debtor must deliver a thing of medium quality.In the case of the preceding paragraph, if the debtor has done whatever is necessary for the delivery of such a thing, or if, with the consent of the creditor, he has designated a thing to be delivered, such thing is designated as the object of the prestation.

給付物僅以種類指示者，依法律行為之性質或當事人之意思不能定其品質時，債務人應給以中等品質之物。
前項情形，債務人交付其物之必要行為完結後，或經債權人之同意指定其應交付之物時，其物即為特定給付物。
