If a person acquires a claim against the injured person by a wrongful act, the latter may still refuse to perform even if the claim for avoidance has been extinguished by prescription.

因侵權行為對於被害人取得債權者，被害人對該債權之廢止請求權，雖因時效而消滅，仍得拒絕履行。
