Where one of the heirs is an unborn child, partition of the deceased's property by the other heirs shall not take place unless the entitled portion of such child has been reserved.In regard to such partition of inheritance, the mother acts as agent of the unborn child.

胎兒為繼承人時，非保留其應繼分，他繼承人不得分割遺產。
