Persons entitled to maintenance shall be limited to those who can not support the living and are unable to earn the living.The limitation in respect of inability to earn a living in the preceding paragraph shall not apply to the case of the elder lineal relatives by blood.

受扶養權利者，以不能維持生活而無謀生能力者為限。
前項無謀生能力之限制，於直系血親尊親屬，不適用之。
