Civil Code Article 1097

Unless it is otherwise provided, a guardian shall, within the limits required for the protection and advancement of the ward's interests, exercise the rights and assume the duties of the parents in regard to a minor child. Where the guardianship is only provisionally authorized by the parents, the function of the guardian shall be limited to those so authorized.When there are disagreements, regarding the ward’s serious rights, among several guardians, the court may designate one guardian to enforce rights.The court may take opinions from the ward, competent authority or organization of social welfare when making preceding decision.

除另有規定外，監護人於保護、增進受監護人利益之範圍內，行使、負擔父母對於未成年子女之權利、義務。
但由父母暫時委託者，以所委託之職務為限。
監護人有數人，對於受監護人重大事項權利之行使意思不一致時，得聲請法院依受監護人之最佳利益，酌定由其中一監護人行使之。
法院為前項裁判前，應聽取受監護人、主管機關或社會福利機構之意見。
