Civil Code Article 1089

The parents shall jointly exercise their rights and assume their duties in regard to their minor child, unless otherwise provided by law. If one of them can not exercise such rights, the rights shall be exercised by the other party. If the parents can not assume the duties jointly, the duties shall be assumed by the parent who has the ability to do so.If there is inconsistency between the parents in the exercise of the rights in regard to the grave events of the minor child, they may apply to the court for the decision in accordance with the best interests of the child.Before the decision of the preceding paragraph, the court shall give the minor child, the authorities concerned, or the social welfare institution a hearing.

對於未成年子女之權利義務，除法律另有規定外，由父母共同行使或負擔之。
父母之一方不能行使權利時，由他方行使之。
父母不能共同負擔義務時，由有能力者負擔之。
父母對於未成年子女重大事項權利之行使意思不一致時，得請求法院依子女之最佳利益酌定之。
法院為前項裁判前，應聽取未成年子女、主管機關或社會福利機構之意見。

父母不能共同負擔義務時，由有能力者負擔之。
