Regulations Governing the Organization of Procurement Evaluation Committee Article 5

A person shall not be selected as, or serve as, a Committee member if one of the following circumstances exists:1. If he/she has been convicted of corruption, malfeasance, or an unlawful act committed in the conduct of government procurement, except where a judgment of acquittal has become final.2. If he/she has violated laws or regulations in the conduct of government procurement, or has committed any of the acts prescribed in Article 7 of the Ethics Regulations for Procurement Personnel, and has been subject to removal from the functionary duties, dismissal from office, deprivation or reduction of pension (i.e., Retirement Allowance, Maintenance Payment to Military officials), suspension, demotion, reduction of salary, a fine, or a disciplinary demerit, except where the original judgment has been revoked and a subsequent judgment has become final, resulting in none of the foregoing circumstances.3. If he/she has been deprived of civil rights and the resumption of rights has not been granted.4. If he/she is a licensed professional and his/her right to practice has been suspended, or his/her practice license has been revoked or abolished.5. If he/she, or a supplier for which he/she serves as the responsible person, has been published on the Government Procurement Gazette pursuant to Paragraph 3 of Article 102 of the Government Procurement Act, during the period of such publication.6. If he/she is under guardianship or assistance and such declaration has not been revoked.7. If he/she has been adjudicated bankrupt, or has been subject to liquidation proceedings under the Consumer Debt Clearance Act, and the resumption of rights has not been granted.
