Enforcement Rules of the Government Procurement Act Article 79

The term "the total price is so low" referred to in Article 58 of the Act means any of the following circumstances:1. where a government estimate is set, the total price is less than 80 percent of the government estimate;2. where no government estimate is set, the total price is determined by a committee or evaluation committee to be unreasonably low; or3. where neither a government estimate is set nor a committee or evaluation committee is established, the total price is less than 70 percent of the budget or the estimated procurement value. Where an appropriation bill is pending for legalization, the estimated procurement value shall govern.
