Enforcement Rules of the Government Procurement Act Article 55

The term "three or more tenders" referred to in paragraph 1 of Article 48 of the Act means three or more tenderers submit their tenders under open tendering procedures which meet the following requirements:1. the tenders have been submitted at the procurement entity or any designated place pursuant to the requirement of Article 33 of the Act;2. no such circumstances exist where the opening of tenders is prohibited pursuant to paragraph 1 of Article 50 of the Act;3. no such circumstances exist where the opening of tenders is prohibited pursuant to paragraphs 1 and 2 of Article 33 of this Enforcement Rules; and4. the tenderers are not prohibited from participating in tendering pursuant to paragraph 1 of Article 38 of this Enforcement Rules.
