Government Procurement Act Article 87
A person who commits violence or threat, administers drugs, or applies hypnosis with the intent to cause a supplier not to tender or to tender contrary to its real intention, or cause the winning tenderer to forego the award or to assign or subcontract after award shall be punished with imprisonment for not less than one year but not more than seven years; in addition thereto, a fine of not more than three million New Taiwan Dollars may be imposed.If death results from the offense specified in the preceding paragraph, the offender shall be punished with life imprisonment or imprisonment for not less than seven years; if aggravated injury results, the offender shall be punished with imprisonment for not less than three years but not more than ten years; in addition thereto, a fine of not more than three million New Taiwan Dollars may be imposed.A person who commits fraud or uses any other illegal means to make the supplier unable to tender or cause the opening of tenders to have an incorrect result shall be punished with imprisonment for not more than five years; in addition thereto, a fine of not more than one million New Taiwan Dollars may be imposed.A person who causes the supplier not to tender or not to proceed with price competition by means of contract, agreement or other forms of meeting of minds, with the intent to adversely affect the price of award or to gain illegal benefits, shall be punished with imprisonment for not less than six months but not more than five years; in addition thereto, a fine of not more than one million New Taiwan Dollars may be imposed.A person who borrows or assumes any other’s name or certificate to tender, with the intent to adversely affect the result of procurement or to gain illegal benefits, shall be punished with imprisonment for not more than three years; in addition thereto, a fine of not more than one million New Taiwan Dollars may be imposed. The foregoing shall also apply to the cases of a person who allows any other person to borrow or assume his name of certificate to tender.An attempt to commit an offense specified in paragraphs 1, 3 or 4 is punishable.

意圖使廠商不為投標、違反其本意投標，或使得標廠商放棄得標、得標後轉包或分包，而施強暴、脅迫、藥劑或催眠術者，處一年以上七年以下有期徒刑，得併科新臺幣三百萬元以下罰金。
犯前項之罪，因而致人於死者，處無期徒刑或七年以上有期徒刑；致重傷者，處三年以上十年以下有期徒刑，各得併科新臺幣三百萬元以下罰金。
以詐術或其他非法之方法，使廠商無法投標或開標發生不正確結果者，處五年以下有期徒刑，得併科新臺幣一百萬元以下罰金。
意圖影響決標價格或獲取不當利益，而以契約、協議或其他方式之合意，使廠商不為投標或不為價格之競爭者，處六月以上五年以下有期徒刑，得併科新臺幣一百萬元以下罰金。
意圖影響採購結果或獲取不當利益，而借用他人名義或證件投標者，處三年以下有期徒刑，得併科新臺幣一百萬元以下罰金。
容許他人借用本人名義或證件參加投標者，亦同。
第一項、第三項及第四項之未遂犯罰之。
