Employees who choose not to be subject to the laws and regulations concerning civil servants in accordance with the second paragraph of the preceding article and loses the original benefits of the civil servants due to switching to Labor Insurance, shall, when receiving retirement benefits under the Civil Servant and Teacher Insurance, repay the compensation amount. If the retirement benefit amount received is less than compensation amount, only the compensation amount equal to the retirement benefit received shall be repaid.

依前條第二項改為不適用公務人員有關法令之人員，因改投勞工保險致損失公教人員保險原有權益時，準用公教人員保險領取養老給付時，應將補償金繳回。
其所領養老給付金額較原補償金低時，僅繳回與所領養老給付同金額之補償金。
