Act for Promotion of Private Participation in Infrastructure Projects Article 44

To evaluate the applications submitted in response to the public notice inviting private participation, the authority-in-charge shall organize a Selection Committee which shall establish the evaluation criteria based on the purpose of the infrastructure project concerned, examine and evaluate the materials submitted by the applicants on a fair basis and then select the best applicant therefrom within the evaluation period.The evaluation criteria referred to in the preceding paragraph shall be announced simultaneously upon the announcement of the public notice inviting private participation. The evaluation period shall be determined on a case-by-case basis and a notice thereof shall be given to the applicants.The regulations governing the organization of the Selection Committee and the evaluation thereof as referred to in Paragraph 1 shall be prescribed by the competent authority. One half or more of the members of the Selection Committee shall be specialists and scholars and the evaluation process shall be made public.
