犯罪在任職服役前，發覺在任職服役中者，依本法追訴審判。
但案件在追訴審判中而離職離役者，初審案件應移送該管第一審之法院，上訴案件應移送該管第二審之法院審判。
犯罪在任職服役中，發覺在離職離役後者，由法院審判。
前二項規定，按行為時之身分適用法律。
