Military trial Article 186
The abandonment of rights of appealing is done in the military court of the first hearing.The withdrawn of the appeal is done in the appealing court. If the files are still in the military court of the first hearing, it is done there.

捨棄上訴權，應向原審軍事法院為之。
撤回上訴，應向上訴審法院為之。
但於該案卷宗仍在原審軍事法院者，得向原審軍事法院為之。
