Act of Military Education Article 16
Paragraph (1)MND can set up preparatory school in order to reserve officer resources under the Citizen Education Act and Primary and Junior High School Act standards.Paragraph (2)The schools MND set up include Junior high school and high school, the establishment, equipment, faculty, course specifics, student requirements, duration, graduation eligibility and degree awarded are follow the education law. The school management should report to the local administration education office.Paragraph (3)The admission of Junior high school and high school is authorized by both Minister of Defense and Minister of Education. The Junior high school is excluding by the citizen education Act Article 6.

國防部為儲備軍官人力來源，得依國民教育法及高級中等教育法規定之標準，設預備學校。
前項學校分設國中部及高中部，其設立、設備、師資、課程綱要、學生資格、修業年限、畢業資格、畢業證書發給等事項，依教育法令規定辦理；學籍管理，應報由學校所在地之主管教育行政機關備查。
國中部、高中部學生入學辦法，由國防部會同教育部定之。
但國中部不適用國民教育法第六條之規定。
