Police Personnel Management Act Article 18

Positions to which police officers are assigned shall be subject to the regulations of the organization act of each police institutions or academies and shall match the officer’s rank and class. If no officers with the required rank and class are available to be assigned to a specific position, a senior officer with good job performance may be assigned to the position despite being ranked one class lower. An officer ranked one class higher may be assigned to a lower position under special circumstances.Qualifications for various positions and the corresponding duties shall be delineated in the table of positions and corresponding ranks and classes; if necessary, one position may be open to two or three classes.The above-mentioned table of positions and corresponding ranks and classes shall be formulated by the Ministry of Civil Service in coordination with relevant agencies under the Executive Yuan after considering the degree of responsibilities and the nature of duties for each position, pending approval by the Examination Yuan.If the positions and corresponding ranks and classes prescribed in the organization acts of the organizations subject to this Act contradict the table of positions and corresponding ranks and classes in this Act before its amendment came into force on May 21, 1997, the provisions in the table of positions and corresponding ranks and classes shall apply temporarily. Nevertheless, if the organization acts of police institutions or academies are amended or formulated after May 21, 1997, the provisions in the organization acts shall apply.
