Housing Act Article 28
Social housing built by a private organization may be a new building or an addition, reconstruction or renovation of an existing building on the same building foundation. Where the social housing is a new building, the building foundation shall meet one of the following requirements:1. Total floor area of at least 500m2 in an urban planning district, and total floor area of at least 600m2 calculated based on building bulk specified in urban planning.2. Type A building land or type B building land of at least 500m2 in non-urban district.3. Type C building land, recreation land or special purpose land of at least 1,000m2 in non-urban district.

民間興辦之社會住宅係以新建建築物辦理者，其建築基地應符合下列規定之一：
一、在實施都市計畫地區達五百平方公尺以上，且依都市計畫規定容積核算總樓地板面積達六百平方公尺以上。
二、在非都市土地甲種建築用地及乙種建築用地達五百平方公尺以上。
三、在非都市土地丙種建築用地、遊憩用地及特定目的事業用地達一千平方公尺以上。
