Regulations Governing Application by Draftees-to-Be for Substitute Services Article 11
Applications for substitute services on account of family factors refer to cases where a draftee’s family status is in conformity with one of the following circumstances:1. All of the draftee’s family members are aged above 65; below 15; or mentally or physically disabled or with major injury or disease; or aged above 15, below 18 and certified by an educational authority-registered school to be attending it.2. The draftee has a child or children or his spouse is pregnant.3. A family member of the draftee suffers from moderate (or above) mental or physical disorders.4. The draftee's parents, spouse, or siblings died or suffered mental and physical disorders during their term of military service, with the fact of indemnity established.5. The draftee's family is listed as a low-income household according to the Public Assistance Act, but it does not apply to a draftee if only himself or his siblings above the age of 18 is/are ratified as low-income.The calculation of the age of the draftee’s family members referred to in the preceding paragraph is based upon the date on which the draftee applies for substitute service.The mental or physical disabilities or catastrophic illness defined in the subparagraph 1 and 3 of the first paragraph refers to the diseases that meet the grade provisions of mental and physical disabilities defined by the central health authority, or the announced catastrophic illness coverage of the national health insurance with supporting documents. Death or mental and physical disorders specified in the fourth subparagraph refer to those who conform to the examination criteria for relief on death or mental and physical disorders grading standards respectively specified for military personnel and draftee of substitute service by the Ministry of National Defense or the Ministry of the Interior and are with supporting documents.If a family member of a draftee has been diagnosed by a physician with stage 2 or higher cancer and has been approved as having a major injury or disease, they may be recognized as having a moderate or higher degree of physical or mental disorders.

因家庭因素申請服替代役，指役男之家庭狀況合於下列情形之一者：
一、役男家屬均屬六十五歲以上、未滿十五歲、患有身心障礙、重大傷病或十五歲以上未滿十八歲經主管教育行政機關立案之學校證明就學中。
二、役男育有子女或配偶懷孕。
三、役男家屬患有中度以上身心障礙。
四、役男父母、配偶或兄弟姊妹服兵役期間，因死亡或身心障礙，有撫卹事實。
五、役男家庭依社會救助法核列為低收入戶。
但僅役男本人或其家屬中僅年滿十八歲之兄弟姊妹核列為低收入戶，不適用之。
前項役男家屬年齡之計算，以役男申請服替代役之日為計算基準。
第一項第一款及第三款所定身心障礙或重大傷病，為符合中央衛生主管機關所定之身心障礙等級規定或其公告之全民健康保險重大傷病範圍之疾病，並持有證明文件者；第四款所定死亡或身心障礙，為符合國防部或內政部分別就軍人、替代役役男所定之死亡撫卹或身心障礙等級規定，並持有證明文件者。
役男家屬經醫師診斷，罹患癌症第二期以上且經核定為重大傷病者，得比照認定為中度以上身心障礙。
