Administrative Appeal Act Article 61
While the administrative appellant expressed an objection to the administrative action to an agency other than the agency which the administrative action was made or the agency with jurisdiction of administrative appeal, it shall be deemed as filed to the agency with jurisdiction of administrative appeal at the first place.The agency which receive and process the administrative appeal stipulated in last Paragraph shall transfer the case to the agency which the administrative action was made within 10 days and notify the administrative appellant.

訴願人誤向訴願管轄機關或原行政處分機關以外之機關作不服原行政處分之表示者，視為自始向訴願管轄機關提起訴願。
前項收受之機關應於十日內將該事件移送於原行政處分機關，並通知訴願人。
